Revenge On The Bad House

Dear RG,
I'm in the process of buying my first house and it has not been a good
experience AT ALL.
Not only
are the sellers VERY difficult to deal with, so is their realtor! The last
straw was this morning when I went to place an order to have my
phone/cable/internet hooked up. The company can not place an order on a
property without that property have had a disconnection request put in. So
in short, the longer they wait to disconnect, the longer I may have to wait
to have said service. I am supposed to move in in just under 3 weeks.
Now this is just the latest thing in a string of asinine happenings such as
refusal to pay for things they agreed on in the contract (such as $25 for a
second water test since THEY did not do the procedure the first time!!) and
I am fully prepared to move in without having a stove, although they agreed
to leave it behind. Now there are certainly legal avenues I will take as
well in these areas but I would like some ideas should I decide to add a
"personal" touch to the proceedings.
Any ideas?

I understand the frustration…. The seller’s realtor is in it for the
easy money, not the buyer’s happiness.
I would check on the realtor’s legal laws in your state… I’m sure you can
check on any lawsuit to go after the realtor instead of the sellers.
Having bought and sold a few houses myself I know that having a realtor on
your side is worth the commission for them to handle the legal issues, but
should they miss something it’s hard to pin them to the responsibility.
Deal with the sellers…. Make sure that their realtor understands the
importance of the “written contract” because if you can show proof that the
realtor has mislead you by not following the contract then you can sure them
and not have to worry about the sellers of the house you’re buying at all.
As for the “personal touch” I don’t know how fragile of a deal you have so
I’m not sure what way to suggest you act.
But if you can get the sellers new address, maybe sending people to their
new house for a “room to rent” might give some satisfaction. I’d suggest
doing this now, but that will be your address soon enough. Who needs the
hassles?
So, deal with the real estate agent, enforce the contract through them, not
the sellers. You shouldn’t be talking to them anyways if they have the
realtor’s help anyways.
Keep notes on everything, have your lawyer (the one who will finalize the
sale) know what has happened, gone wrong and might go wrong after closing.
Don’t let anything slip, even the $25.00 bills can be a deal breaker, or a
great future lawsuit, your choice.
